Can your rental contract end automatically?

In these situaties, your rental contract stops automatically:
  1. You are the only tenant and you die: Your rental contract ends automatically at the end of the second month after your death. Your heirs must pay the 2 months rent plus a compensation of 1 month's rent. But they can also decide to continue your rental contract. They must notify the landlord within 2 months of your death.
  2. Your rental property is completely destroyed by accident. Examples are fire, flood, tornado and so on. Your rental contract then stops automatically. Is your rental property only partially destroyed? Then you can ask the justice of peace for reduction of the rent or the termination of your rental contract.
  3. You have a student rental contract. Your rental contract ends automatically on the end date of the contract.
In these situaties, your rental contract does not stop automatically:
  1. Your landlord dies. The heirs of the landlord take over your rental contract automatically. 
  2. Your landlord sells the rental property. The buyer automatically takes over your rental contract.
  3. Your landlord is bankrupt. The bakruptcy trustee can decide to end your rental contract. This does not happen automatically. 
  4. Your rental property has been declared unfit or uninhabitable. Contact us to discuss the consequences.
