Who repairs and maintains the rental property?

What should you do as a tenant?

  • maintain the rental property: clean chimney, clean windows, maintain garden ...
  • maintain the central heating system. Read the obligations for central heating and fuel oil tank. 
    • gas central heating: maintenance every two years 
    • oil-fired central heating with underground fuel oil tank: annual maintenance
    • oil-fired central heating with an above-ground fuel oil tank: no regular maintenance is required here, unless it is specified in your rental contract. 

You have the right to request the latest maintenance certificate from the landlord. This allows you to see when the next maintenance is due. Are you already renting the rental property at that time? Then you are responsible for that maintenance.

  • do minor repairs. From 2019, there is a list of minor repairs that you, as a tenant, have to do. This list contains the most common minor repairs. Look at the bottom of the page. 
  • repair damage you have caused yourself.

What should your landlord do?

  • carry out major repairs
  • repair damage caused by wear and tear, age or force majeure

Do you have a problem of damage in the rental property?

Report it immediately to your landlord. As a tenant, you have an obligation to report it. Always do this in writing: by letter, e-mail or text message. 

Didn’t report the problem or damage? Then you can be held liable for additional damage. 

Does the landlord not repair the damage after your report? Then contact the Huurdersbond.
